Terms of Service

SwiftEx Wallet (“SwiftEx”, “we”, “our”, or “us”) is a non-custodial digital asset wallet application operated by 3-102-938072 SOCIEDAD DE RESPONSABILIDAD LIMITADA, a limited liability company incorporated in Costa Rica (Corporate ID No. 3-102-938072), with its registered address at:
Provincia 01 San José, Cantón 02 Escazú, Distrito San Rafael, del Centro Comercial La Paco trescientos metros norte, Plaza Florencia, Local Diez, Costa Rica.
By accessing or using the SwiftEx Wallet application (“App”), you agree to be bound by these Terms of Service (“Terms”).
Your use of the App is also governed by our Privacy Policy, available within the App.
1. Description of Service
- Generate and manage blockchain wallet credentials
- Interact with public blockchain networks
- Interface with decentralized protocols (including swaps and bridges)
- Connect to third-party fiat-to-crypto services
- View blockchain data and transaction status
2. Non-Custodial Nature of the Wallet
- You retain sole control of your private keys and recovery phrase
- SwiftEx cannot access, recover, or reset your wallet
- Loss of wallet credentials may result in permanent loss of assets
- Blockchain transactions are irreversible
- You are fully responsible for safeguarding your wallet credentials.
3. No Financial Services
- Custody of assets
- Brokerage services
- Exchange services
- Money transmission
- Investment advice
4. Third-Party Services
- Fiat on-ramp/off-ramp providers
- Decentralized protocols (swaps, bridges, staking, etc.)
- Blockchain networks and nodes
5. User Responsibilities (Acceptable Use)
- Money laundering or terrorist financing
- Sanctions evasion
- Fraud or illegal activities
- Transactions involving illegal goods or services
- Circumventing geographic restrictions
- Interfering with the App’s operation
- Attempting to gain unauthorized access to other wallets, networks, or systems
6. Risks of Blockchain Technology
- Smart contract vulnerabilities
- Network congestion and fees
- Protocol failures or exploits
- Price volatility
- Total loss of digital assets
- Digital assets may become worthless.
7. Fees
Network fees, protocol fees, or third-party service fees may apply. These are not set by SwiftEx.
8. Limitation of Liability
- Loss of digital assets
- Unauthorized wallet access
- Smart contract or protocol failures
- Third-party service issues
- Blockchain network disruptions
- Indirect or consequential damages
9. Disclaimer of Warranties
The App is provided “as is” without warranties of any kind.
10. Intellectual Property
All intellectual property rights in the App belong to SwiftEx or its licensors. You receive a limited, non-exclusive license to use the App for personal, non-commercial purposes.
11. Termination
SwiftEx may restrict access to the App if you violate these Terms.
This affects only your access to the SwiftEx interface. You retain full control of your wallet through your private keys and recovery phrase. SwiftEx cannot freeze or seize your assets.
12. Age Requirement
The App is intended for individuals aged 18 or older.
13. Changes to Terms
We may update these Terms. Continued use of the App constitutes acceptance of updated Terms.
14. Governing Law
These Terms are governed by the laws of Costa Rica.
15. Severability
If any part of these Terms is found invalid or unenforceable, the remaining parts remain in full effect.
16. No Class Actions
To the extent permitted by law, disputes arising from these Terms shall be resolved on an individual basis, and you waive the right to participate in class actions or collective proceedings.
